Agreement to terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ThePetsMonk ("we," "our," or "us") governing your access to and use of our pet grooming management software and website (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Description of service

ThePetsMonk is a cloud-based pet grooming management platform that provides:

• Online appointment scheduling and booking
• Client and pet profile management
• Automated email reminders and notifications
• Business analytics and reporting
• Online booking page for your customers
• Pet vaccination and health record tracking

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

Account registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may not share your account credentials with others or allow multiple people to use a single account, unless authorized as part of a team or staff feature.

Free service

ThePetsMonk is currently provided free of charge. We reserve the right to introduce paid features, premium tiers, or modify our pricing structure in the future. If we do so, we will provide you with reasonable notice and you will have the option to continue using any free features or discontinue use of the Service.

Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use the Service to send spam, unsolicited messages, or advertisements
• Impersonate any person or entity
• Collect or harvest user data without consent
• Use the Service in a manner that could damage, disable, or impair the Service
• Reverse engineer, decompile, or disassemble any part of the Service

Your data

You retain all ownership rights to the data you input into the Service, including client information, pet records, appointment details, and business data ("Your Data"). We do not claim any ownership over Your Data.

You grant us a limited license to use, store, and process Your Data solely for the purpose of providing and improving the Service. We will not sell Your Data to third parties.

You are responsible for ensuring that you have the necessary rights and consents to input any personal data into the Service, including data about your clients and their pets.

Data export and deletion

You may request to export Your Data at any time by contacting us. If you delete your account, we will delete Your Data within 30 days, except where we are required to retain it for legal or regulatory purposes.

Intellectual property

The Service, including its original content, features, and functionality, is owned by ThePetsMonk and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes, subject to these Terms.

Third-party services

The Service may integrate with or contain links to third-party websites, services, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms of service.

Service availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We may temporarily suspend access to the Service for maintenance, updates, or other reasons without prior notice.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or that any defects will be corrected.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ThePetsMonk, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors, bugs, or service interruptions
• Any loss of business, clients, or revenue

In no event shall our total liability to you for all claims exceed the amount you paid us (if any) in the twelve (12) months prior to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless ThePetsMonk and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

Termination

You may terminate your account at any time by contacting us or using the account deletion feature in the Service. We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Dispute resolution

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at contact@thepetsoftware.com. We will attempt to resolve the dispute through good-faith negotiations within 30 days.

Changes to terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ThePetsMonk regarding the Service and supersede all prior agreements and understandings.
